State of West Bengal challenge against the Calcutta High Court after making out a prima faice case and challenge the direction for CBI investigation in the case of post-poll which is related to murder and rape, a notice was issued by the apex court on its petition.
The State of West Bengal filed a special leave petition against the order of the Calcutta High Court on August 19.
The Senior Advocate Kapil Sibal who was appearing on the behalf of West Bengal Government further stated that “They said there’s inaction on part of the state” , what actually happened there was actually under the knowledge of every citizen and this matter is also about the reputation of the state government also. He further argued that you didn’t give us any opportunity , you castigate & pass an order. He further added that the high court make an assumption and further processed that the state entire police force is not trustworthy and they don’t have any factual basis to support this statement.
Sibal further sought for the direction that the CBI must be restrained from registering any fresh FIRs. To which the bench said that nothing is going to happen until the next hearing of the Court.
