Lakshadweep administration moots proposal to shift HC jurisdiction from Kerala to Karnataka


The Lakshadweep administration, which has faced considerable public outrage over several of its practises, has proposed shifting its legal jurisdiction from the Kerala High Court to the Karnataka High Court, according to authorities. The government launched the initiative after several lawsuits were filed against the decisions taken by the islands’ new administrator, Praful Khoda Patel, before the Kerala High Court.
Patel, the administrator of Daman and Diu, was given additional responsibility of the Union Territory of Lakshadweep in the first week of December last year, after former administrator Dineshwar Sharma died following a brief illness. These decisions included revising standard operating procedures for Covid appropriate behaviour, introduction of the “goonda act” and demolishing hutments of fishermen for widening of roads.
According to Article 241 of the Indian Constitution, the High Court’s jurisdiction can only be changed by an act of Parliament. According to Article 241, Clause (1), the Parliament may, by law constitute a High Court for a Union Territory or make a court in the territory to be the High Court for any such purposes made by the Constitution.
The move to shift High Court jurisdiction comes in the backdrop of several petitions being filed before the Kerala High Court against the new administrator of Lakshadweep, Praful Patel, regarding the proposed Lakshadweep Development Authority Regulation, Lakshadweep Prevention of Anti-Social Activities Regulation (Goondas Act) and Lakshadweep Animal Preservation Regulations, which effectively introduces a ban on beef on the island. This year, as many as 23 applications, including 11 writ petitions, have been filed against the administrator of Lakshadweep, as well as the alleged high-handedness of either the police or the islands’ local government.
The Kerala Assembly approved a unanimous motion seeking the recall of the new Administrator.
