On 29 July’ 2021, the heartbreaking news of daylight murder of Uttam Anand, Additional District Judge of Jharkhand came forward. The news was brought up by Senior Advocate Vikas Singh, also the President of the Supreme Court Bar Association, before the bench headed by DY Chandrachud who called this incident as “brazen attack on judiciary”.
The CCTV footage of vehicle hitting judge while he was out on his morning walk, came out on 28th July’ 2021. Vikas Singh pointed out that footage shows that person was seen zooming the visuals as if to make sure that the judge was killed. The incident took place on public road in Dhanbad.
Vikas Singh urged Supreme Court to take suo moto cognisance of the issue. He added that this matter should go to CBI as ADJ Uttam Anand was dealing with gangsters bail application and local police is commonly seen hesitant and unlawfully involved in such matters.
He also said that this incident is an attack on judicial independence.
On his appeal, Chandrachud suggested to discuss this case with Chief Justice of India instead and even used his good offices to convey the message to CJI.
CJI NV Ramana, when case was mentioned before him by Vikas Singh, informed that he discussed matter with Chief Justice, Secretary General and Registrar General of the Jharkhand HC and case has been taken up by Chief Justice of Jharkhand High Court.
While Vikas Singh still insisted that case should be taken by CBI or “there will be no judiciary in this country” if judge gets killed while dealing with gangsters cases, still CJI insisted that SC don’t need to be involved in present juncture.
The offending vehicle, an auto-rickshaw, was later seized and two suspects were arrested. The auto-rickshaw was found to be stolen vehicle previously before incident and the accused were reported to be arrested from petrol pump.
